Terms of Service
Effective date: June 1, 2026
These Terms of Service ("Terms") govern your access to and use of the FinStack platform and APIs. By creating an account or using the platform, you agree to these Terms.
1. The Service
FinStack provides a developer platform for building financial products, including composable API primitives (payment, fraud, tax, ledger, and others), a native MCP server, workflow orchestration, and associated infrastructure. The platform is provided on a subscription and usage basis as described on our Pricing page.
2. Accounts and API Keys
You are responsible for maintaining the confidentiality of your API keys. API keys beginning with sk_live_ grant full write access to your tenant — treat them as passwords. You must notify us immediately at security@finstack.sh if you believe a key has been compromised.
3. Acceptable Use
You may not use FinStack to:
- Process transactions for illegal goods or services, including unlicensed gambling, counterfeit goods, or controlled substances
- Facilitate money laundering, terrorist financing, or sanctions evasion
- Circumvent fraud detection or abuse the Fraud primitive to harm third parties
- Conduct denial-of-service attacks or attempt to reverse-engineer the platform
- Resell API access without a written white-label agreement
- Store cardholder data in your tenant database (use the Payment primitive's tokenization)
4. Billing and Payment
Subscription Plans
Subscription fees are billed monthly in advance. Unused API calls do not roll over. Overages are billed at the rates listed on the Pricing page and invoiced at the end of each billing cycle.
Payment Processing Fees
Payment primitive transactions incur per-transaction fees in addition to the subscription. These fees are deducted from the transaction amount or charged to your FinStack balance as configured.
Late Payments
Accounts more than 15 days past due may be suspended. Accounts more than 45 days past due may be terminated, subject to a 7-day notice.
5. Service Levels
We target 99.9% API uptime on Builder and Scale plans, and 99.99% on Enterprise plans (as defined in individual Enterprise agreements). Scheduled maintenance is excluded from uptime calculations and announced at least 24 hours in advance. Our status page is available at finstack.sh/status.
6. Data and Security
You retain ownership of all data submitted to the platform. By using FinStack, you grant us a limited license to process your data to provide the service. Our security practices and data handling are described in our Privacy Policy.
7. Intellectual Property
The FinStack platform, APIs, and documentation are our intellectual property. We grant you a non-exclusive, non-transferable license to access and use them during your subscription. Open-source SDKs are licensed under their respective licenses as noted in the repository.
8. Termination
Either party may terminate at any time with 30 days' written notice. We may terminate immediately for material breach of these Terms (including acceptable use violations). Upon termination, your data is retained for 90 days before deletion to allow export.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINSTACK'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS IS LIMITED TO THE FEES YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM. WE EXCLUDE ALL LIABILITY FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Disputes shall be resolved by binding arbitration in San Francisco, CA, under JAMS rules, except for injunctive relief sought in connection with intellectual property.
11. Changes
We may update these Terms with 30 days' notice via email or dashboard notification. Continued use after the effective date constitutes acceptance.
